Farm Animal Transparency (FAT)’s weekly Environmental Watch — a digest of environmental permits, litigation, and settlements involving companies in the meat, poultry, and seafood supply chains. Full details, classifications, and sources for every matter live on the Environmental Watch tracker.
No confirmed new developments this week. FAT searched for movement on every tracked matter and located no new rulings, filings, settlements, or agency actions that could be verified from a published source. Items below are open and unchanged; where FAT could not read a primary docket, it says so.
Oklahoma poultry-litter settlement: joint motion to vacate still pending
As previously reported, all parties filed a joint motion on September 22, 2026 asking U.S. District Judge Gregory Frizzell (N.D. Okla.) to vacate his December 19, 2025 judgment so the July 2026 settlement can take effect, and asked for an expedited ruling. FAT located no ruling, hearing date, or objection in published reporting this week; FAT could not read the district-court docket directly. Classification remains Settlement — not final: the settlement takes effect only on vacatur plus dismissal with prejudice, and the six-month window closes on or about January 10, 2027 — now less than three months away. EPA offshore seafood-processor NPDES proposal: comment period closes
The public comment period on EPA’s proposed rule (91 Fed. Reg. 56819, Sept. 4, 2026) that would exempt offshore seafood-processing operations more than three nautical miles from shore from NPDES permitting and reporting closes today, October 19, 2026. It is a proposal only — not final, and no legal challenge has been filed. Federal Register notice · Alaska Public Media (Sept. 23, 2026)
No change this week
FAT located no new developments on: the Oakridge Dairy digestate-storage permit in Somers, Connecticut; REACH v. EPA (D.C. Cir. No. 25-5354 — no oral-argument scheduling located; tracker); United States v. Ganaderos Borges, Inc. (Puerto Rico — allegations only); Waterkeeper Alliance v. EPA (tracker); Pacific Seafood’s citizen suits and Oregon DEQ penalty (reported under appeal; outcome unconfirmed, so the penalty is not described as final); the JBS Greeley air-permit suit; Texas v. Darling Ingredients (temporary injunction in place; final-injunction hearing July 2027); the Perdue AgriBusiness PFAS litigation in Salisbury, Maryland (sanctions motion still unresolved in published reporting); the Conservation Law Foundation’s Clean Water Act suit against Cooke Aquaculture in Maine (allowed to proceed past a motion to dismiss, as reported October 12; Cooke denies the allegations); or the EPA enforcement log. All remain as previously reported — allegations only unless labeled otherwise.
FAT also reviewed its North Carolina swine-CAFO regulatory cluster and located no confirmed movement on any of the six threads: no new Environmental Management Commission rulemaking on animal waste, phosphorus, or floodplain groundwater monitoring; no Supreme Court disposition of the Randolph Cnty. v. Stein petition (the Environmental Enhancement Grants program remains paused per NCDOJ); no Title VI resolution; no general-permit renewal action; and no new Align RNG permitting or CARB action.
Also on FAT’s watch list: Shenandoah Valley Organic (the “Farmer Focus” chicken brand) in Harrisonburg, Virginia — repeated pretreatment-permit notices of violation reported June 2026. No escalation located. Not yet a tracker matter.
